Police arrested Smith Thursday night after an officer got behind his car and noticed Smith ran a red light.

The officer said when he walked up to Smith’s car he could smell the odor of alcohol coming from the car and then started asking Smith some questions.

Smith told the officer he was at Hal’s restaurant where he has a single beer and it had been 45 minutes since he had the last drink.

The officer said Smith first refused to take a breathalyzer test, but once it was explained to him that he would be arrested he started the sobriety test, which he had trouble completing.

DUI Charges John Goodman, Wellington polo mogul, DUI manslaughter trial

Posted on 13th January 2012 in DWI / DUI Convictions

Circuit Judge Jeffrey Colbath did not set a hearing date for Goodman’s request that the trial be moved outside of Palm Beach County. Goodman argues that The Palm Beach Post’s coverage of the case has poisoned prospective local jurors.
Goodman was arrested and charged with DUI manslaughter three months after the Feb. 12, 2010 car crash that led to Wilson’s death. The 23-year-old man drowned after Goodman’s car hit his, causing it to overturn and plunge into a canal.
Goodman is represented by attorneys Roy Black and Mark Shapiro, who filed nearly 100-page motion last week, saying that Goodman has been the target of “an unrelenting media blitzkrieg” ever since the crash.

DUI news Grant

Posted on 11th January 2012 in DWI / DUI Convictions

The grant—from the California Office of Traffic Safety—was approved today by a 4-0 vote of the Board of Supervisors. The funds will be used to establish a specialized unit in the DA’s southwest office.

“The southwest portion of Riverside County was chosen for the target area of this grant due, in part, to it being the fastest-growing region of the county, Temecula’s Wine Country being there, and several recent high-profile DUI-related homicides happening in the area,” said District Attorney’s Office Spokesperson John Hall, in a news release.

DUI Charges Nickolus Borgman in Lancaster County

Posted on 10th January 2012 in DWI / DUI Convictions

Nickolus Borgman pleaded no contest to aggravated, third-offense driving under the influence.

According to a Lancaster County Sheriff’s Office report, a deputy stopped Borgman at about 2:30 a.m. Feb. 18 after getting a call about someone driving very slowly near Southwest 140th and West A streets.

The deputy stopped the Ford F-250 for having an overloaded front seat after seeing four people in the front, and found the two men and two women inside were naked.

In court records, the deputy said a strong odor of alcohol came from the cab; a Busch Light beer box, empty cans and clothing were in the truck bed; and two open cans were in the cab.

When the deputy asked what they were doing, one of the four said, "Well, I think we’re getting in trouble," according to a sheriff’s office report.

Borgman was taken to Cornhusker Place Detox, with a blood alcohol level of .171, and records showed he had DUIs in 2002 and 2010. If he doesn’t get probation, he faces as many as five years in prison when he’s sentenced March 14.
