Eric James Himbarger, 45, of Red Bluff makes arrest 24 since the campaign began Dec. 17.

The total is five more than 2009, which had 19 during the same 13-day period.

Eric M. Barth a “flight risk and clearly a danger to the public,” Kane County Associate Judge James Hallock granted Prosecutor Steve Sims’ request for the high bail. Should Barth be released on bond, he will be required to wear an electronic anklet that monitors alcohol consumption, and to abstain from alcohol. A blood test taken at Sherman Hospital in Elgin after the crash indicated he had a blood-alcohol content of .271, more than three times the legal threshold, according to court records.

Barth, who previously lived in South Elgin, faces six counts of aggravated driving under the influence of alcohol. The counts are aggravated, Sims said, because he is accused of driving without a valid license and because the crash caused “great bodily harm.”

It is illegal to drive a motor vehicle while "impaired to the slightest degree," per Arizona Revised Statutes 28-1381. Penalties for a DUI conviction depend on the level of impairment, frequency of conviction and aggravating factors that could bump the act from a misdemeanor to a felony.

Misdemeanor DUI:

Basic DUI: Impaired to the slightest degree by alcohol or drugs.

Commercial DUI: Body alcohol content above 0.04 and driving a commercial vehicle.

Minor DUI: Under 21 years old with any alcohol in system.

Per se DUI: Body alcohol content above 0.08 within two hours of driving.

Extreme DUI: Body alcohol content above 0.15 (extreme DUI) within two hours of driving.

Super extreme DUI: Body alcohol content of .020 within two hours of driving.

Drugs DUI: An illegal drug or its metabolite in your system (no impairment required).

Felony DUI:

Aggravated DUI priors: You have two or more prior DUI convictions in Arizona or in another state within seven years of the arrest.

Aggravated DUI restricted license: Your privileges to drive are revoked, suspended or restricted at the time you are charged with DUI in Arizona.

Aggravated DUI with child in vehicle: You have a child under 15 years old in the vehicle.

Consequences

A person who is convicted for a first-time misdemeanor DUI:

• Will be sentenced to serve at least 10 days in jail.

• Must pay a fine of at least $250.

• May be ordered by a court to perform community service.

• Must pay an additional fee of $500 for the state’s prison construction and operations fund.*

• Must pay an additional fee of $500 for the state’s public-safety equipment fund.*

• Must equip his or her motor vehicle with a certified ignition interlock device for at least 12 months at an out-of-pocket cost of between $70 and $150 for installation and a monitoring fee of almost $90 a month.

• Must complete a court-ordered alcohol or other drug-screening, education or treatment program, paid for out-of-pocket. Costs vary.

• Will have his or driver’s license suspended for at least 30 days with some restrictions after it is restored.

• Must pay a jail fee of about $175 a day for incarceration.

• Must attend a Mothers Against Drunk Driving victim-impact panel, $35 paid for out of pocket.

• Supervised or unsupervised probation for one to two years, for which there is a fee. Costs vary.

• A person convicted of a second DUI within seven years or convicted of felony DUI could see fines and penalties double.

* If the conviction occurred in a superior court or a justice court, the court shall transmit the assessed monies to the county treasurer. If the conviction occurred in a municipal court, the court shall transmit the assessed monies to the city treasurer. The city or county treasurer shall transmit the monies received to the state treasurer.

DUI Arrest : Michael R. Isaacs, Richmond

Police say officers responded to a shots fire called at a home along Woods Trail around 10 a.m. Tuesday. When officers arrived, the resident told them Michael R. Isaacs, 39, grabbed a handgun belonging to him and fired two shots into the wall above his head.

Police say Isaacs left before officers arrived, but returned a short time later driving a van. Officers say they detected the odor of alcohol and arrested Isaacs for DUI. After investigating, police also charged Isaacs with wanton endangerment for the shooting incident.

DUI Arrests: Aileen F. Beernink, Chicago

This is her third time possibility killing somone.

Aileen F. Beernink, of the 1600 block of Estate Circle in Naperville’s Ranchview neighborhood, was arrested about 2:50 a.m. Sunday while traveling on the 1100 block of Emerald Drive in the West Highlands neighborhood, the Naperville Sun reported, citing police reports. She may be facing jail time because this is her 3rd DUI Arrest.

A patrol officer, who stopped her because she was driving her vehicle with its headlights off, determined Beernink was under the influence of an unspecified narcotic and had a suspended or revoked license, the reports stated.

In 2008, She was also arrested by Naperville police in some different cases involving possession of less than 30 grams of cannabis and driving too fast for conditions, according to court records. In other incident, she was ticketed for not driving with proper headlights.

DUI Charges: Brian Wayne Pitts, Woodford, dec 28, 2010

Brian Wayne Pitts, 31, of Woodford, is charged with felony DUI, driving on a suspended license, refusal to take a breath test and for speeding 68 mph in a 55 mph zone. His vehicle was towed and impounded for a required 30 days.

Timm said the charge was elevated to a felony since the driver had multiple DUI convictions.

Pitts in Rappahannock Regional Jail without bond.

Timm said the sheriff’s office in conjunction with neighboring localities boosted emphasis on unsafe driving behavior during the holidays.

DUI Charges: Joshua J. Kemper, Chicago, dec 28, 2010

Joshua J. Kemper, of Lyons, was ordered held on $150,000 bond in a Monday hearing, Riverside police said. He was charged with felony fleeing and eluding police, two counts of felony DUI, resisting arrest and 14 traffic violations.

Kemper previously caused a disturbance at a bar in Stone Park and is also wanted on an active warrant issued by the Cook County Sheriff’s police for a prior DUI arrest, police said.

DUI Charges: Sarah Beth Biggins, Lockwood , Dec 28, 2010

34 years old Sarah Beth Biggins appeared in Justice Court by video from the county jail on felony charges of criminal endangerment and DUI. She is also charged with a misdemeanor offense of having an open alcohol container in a vehicle.

Judge Pro Tem Brandon Hartford set bond at $50,000 after prosecutors said Biggins has four prior DUI convictions. Biggins also has a felony criminal endangerment conviction that was originally charged as a felony DUI, Deputy County Attorney Julie Mees said.

Biggins’ most recent arrest happened Monday evening when a deputy checked on a report of a possible drunken driver in Lockwood on Highway 87 East.

DUI News: Orange County Police arrested 300 People during holiday, and 4 DUI-related fatalities

From Dec. 17 to Dec. 26, authorities reported 4 DUI-related fatalities and 340 DUI arrests in O.C. cities.

Last year’s number is 399 people with DUI Arrests.

The campaign name is "Avoid" – including the the Orange County Sheriff’s Department , California Highway Patrol, and police departments will continue until Jan 2

CHP officer Denise Quesad says that The California Highway Patrol made 33 DUI arrests on O.C. freeways during its maximum-enforcement period.

Overall in the state, there were four fatalities and 658 DUI arrests over the Christmas holiday weekend, said Fran Clader, spokeswoman for the CHP.

"Motorists need to be aware that many enforcement agencies are targeting drinking drivers and as a result arrests for DUI in the state have increased by 18 percent since 2001," said Steven Bloch with the Automobile Club of Southern California.

DUI Arrest: Thomas M. Nevins, Litchfield, Dec 23, 2010

Long-time assistant state’s attorney Edwardsville police arrested 53-year-old Thomas M. Nevins of Litchfield at 5:04 p.m. Thursday Dec 23rd 2010 at the intersection of Buchanan and Vandalia streets in downtown Edwardsville. Nevins worked there since 1996

State’s Attorney Thomas Gibbons sorta fired him. He said:

"This was a very difficult decision for me as I have known Tom for a long time and he is highly respected as a prosecutor. However, this was a necessary decision in order to maintain the high degree of professionalism and integrity that the people of Madison County deserve and have come to expect of my office."
